HOA and CDD at Legends Preserve

HOA

  • There is an HOA. The only dues figure we found is from a 2024 sale and may be out of date. Not confirmed yet — ask us for the current figure.
  • Neighborhood association: the Legends Preserve homeowners association (developer Meritage Homes of Florida; JCH Daytona, LLC is a designated builder). LPGA area, Daytona Beach, Volusia County.
  • 2023 budget (264 single-family lots): $1,020.02 per year, about $85 per month. The draft declaration capped first-year dues at $1,025, with Board increases up to 15% a year. The budget is from 2023, so get the current figure.
  • Master association: International Residential Owners Association, Inc. (IROA), LPGA International. The 2024 approved IROA budget is $70.75 per unit per year (1,905 units). The master declaration also allows original, annual, recreational, special and enforcement assessments. Its original (one-time) assessment was $100 for a lot's first purchaser.
  • Due at every sale: a transfer fee of 10% of the current annual HOA assessment, paid by the buyer.
  • Due at closing: a $1,000 CIAC capital contribution on the builder sale, which recurs on later sales (the Association may raise it up to 25% a year). The first buyer after construction also pays a reserve contribution of one-sixth of the annual assessment.
  • The 2023 HOA budget includes a management fee line, but no manager is named. The Indigo CDD uses Governmental Management Services, LLC (district manager) and Solaris Management (field services).

CDD

  • Not confirmed — we're checking. Ask us before you write a contract.
  • If there is a CDD, its assessment would appear on the Volusia County property tax bill and would vary by lot.
  • Legends Preserve is inside the Indigo Community Development District (CDD), a separate government district whose assessments appear on the county property tax bill, in addition to HOA and IROA dues.
  • Indigo CDD FY2023 adopted budget: the operations and maintenance assessment was $224.75 per platted unit (net, before the roughly 6% collection and discount add-on). It pays for landscaping, lakes, conservation easement (gopher tortoise habitat), street trees, entrance lighting and the I-95 interchange landscaping.
  • The CDD also has outstanding bonds (Series 1999A, 1999C, 2005 and 2021, with the 2021 bonds running to 2052). The FY2023 budget does not show which bond series, if any, apply to Legends Preserve lots or the per-lot debt amount. Get the lot-specific CDD debt assessment from the district manager or the Volusia County tax bill.
  • Every sale contract must include the statutory bold-print CDD disclosure.

Rules that affect daily life

TopicWhat the documents say
Two layers of rulesLegends Preserve has its own HOA, and it is also part of LPGA International. Owners answer to the neighborhood HOA and to the master association, the International Residential Owners Association (IROA). Exterior changes generally need approval from both the HOA's Architectural Committee and the master Architectural Review Committee (MARC).
RentingThe Legends Preserve declaration on file sets a minimum lease of 30 days. Owners must give tenants the community documents, report tenant and manager contact information to the Association, and are responsible for tenant violations. No 'For Lease' signs for 24 months after the builder's first sale of a home. Check the LPGA master declaration for any longer master-level minimum. Its use-restriction pages did not come through in the copy on file.
PetsDogs, cats and common household pets are allowed (types and breeds acceptable to the Board), but not for breeding or commercial use or in unreasonable numbers. Dogs must be leashed whenever outside the home. Other pets must be leashed or in a fenced yard. Owners must pick up waste. Nuisance animals can be barred.
Vehicles and parkingCars, non-commercial trucks and motorcycles used for daily driving may park in driveways. Nothing may park in the front yard or on common areas, including RVs, boats, trailers and golf carts. Commercial vehicles and very heavy vehicles (Class 5 or above) must be kept out of view in the side or rear yard. Guests may park on the street for up to 24 hours. Oversized vehicles may park on the street in daylight only. Inoperable vehicles must be garaged. Violators can be towed at the owner's expense. Garage doors must stay closed except when in use.
FencesEvery fence needs written approval. Conflict: the Legends Preserve declaration allows beige PVC or black wrought iron or aluminum up to 6 feet, limited to black open metal no taller than 5 feet on pond or conservation lots. The IROA (MARC) Development Code says only aluminum picket fencing will be considered (no vinyl, chain link or wood), with a hedge planted along the fence. Plan on black aluminum.
Pools and screen enclosuresIn-ground pools, spas and screen enclosures need written approval (MARC as well as the HOA). Above-ground pools are not allowed. Enclosures can be no taller than 12 feet or the roofline, may not extend past the sides of the house without approval, and must have a hedge around the perimeter. MARC requires bronze frames with charcoal screen. The HOA declaration allows bronze or black. A pool added after the home is built carries a $100 MARC review fee and a $1,000 refundable deposit (per the Development Code).
Exterior changesAny exterior change, including paint color, landscaping beds, driveways, lighting, decorative objects, play equipment and sheds, needs prior written approval. MARC approvals must be completed and pass final inspection within 120 days. Repainting the same colors needs no application. No vinyl siding, no window or wall AC units, and no security bars, awnings or shutters without approval. Street-facing window treatments must be neutral (white or off-white).
Hurricane shuttersShutters must be an approved type. They may go up 48 hours before a storm and must come down within 72 hours after the watch or warning ends. They may not stay closed during hurricane season.
SignsOnly one 'For Sale' or 'For Rent' sign in the IROA standard design (18 by 24 inches on a white post no taller than 40 inches). The HOA declaration also limits it to 60 days after notice to the Association. Political signs are allowed 30 days before an election (one per lot, up to 24 by 36 inches) and must come down within 3 days after. U.S. flags up to 4.5 by 6 feet attached to the home are allowed. Flagpoles need approval.
TrashCans must be lidded, screened from the street, and put out only for collection. Because of wildlife (bears, alligators and others), the Association may require bear-resistant cans, and leaving cans out overnight before pickup is a listed wildlife-attracting behavior. Do not feed wildlife.
Other restrictionsPortable basketball hoops must be stored inside when not in use. No hoops attached to the house. No tree houses, skateboard ramps or tennis courts. Holiday lighting must come down within 14 days after the holiday. Some lots border golf facilities that are not HOA property, and owning a home gives no right to use them.

Amenities
